Terms and Conditions

Parent/Guardian Terms and Conditions

The following Terms and Conditions form the basis of a Contract between You and Clear Water Sports (hereafter referred to as CWS).  Please take the time to carefully read this Contract.  By confirming with payment, you are acknowledging that you have read, understood, and agree to the following terms and conditions.

  1. Teaching Policies and Procedures.

All CWS Instructors are ASA/STA qualified:

We will endeavour to provide a temporary replacement Instructor in the event of any Instructor absence. We reserve the right to replace Instructors, if necessary once the term has started and cancellation due to instructor change is not valid.  Due to inhouse training, we may have a second Instructor/helper in the pool as part of their training to become an ASA/STA Instructor or Pool Helper.

CWS Staff can only be responsible for students during their swimming lesson and parents and /or guardians are responsible at all other times.  The swimming lesson begins when the Instructor accepts charge of the student from the parent or guardian and ends when the student is returned to the designated pick-up and drop-off point at the end of the lesson.  It is very important that you or your appointed guardian are present at the designated pick-up and drop-off point at the end of the lesson.  At the start of the child(s) booking they will be provided with a coloured band stating which Instructor they have been assigned to.  At the start of each term please present your child(s) band to reception to ensure any movement is updated.

Parents must ensure up-to-date contact details are held by CWS.  This is imperative in case of the unlikely event of a medical emergency, building evacuation or other situation.

Please note the building in which CWS lessons take place in owed by The Army and it is their legal right to stop us from using their facilities if they deem the conduct of CWS staff, students and parents/guardians warrants this.

  1. Booking and Payment.

By paying, you are acknowledging that you have read, understood and agree to the terms and conditions.  All bookings are accepted on a “first come first served” basis and we cannot guarantee your choice of day and time.  To guarantee your booking is processed correctly, please pay for your child within given time.  Please note we do not reserve or hold any places unless there are special circumstances and only by prior arrangement.  It is your responsibility to book your place on time, failing to process your payment online will mean you will not have a place for the new term. Failure to make payment on time or for any returned unpaid Direct Debits will result in a £20 administration fee being added to your account.

  1. Cancellation and refunds.

If you wish to cancel a confirmed booking once the term as started, no refund or credit will be offered unless on medical grounds (see below).

Missed lesson(s): All Instructors and pool sessions for a Term are contracted and agreed well in advance of the start of term.  We are therefore unable to refund any money for sessions missed because of a) General illness to either parent/guardian or child b) Holidays confirmed prior to or taken during the term c) Late arrival or non-attendance (voluntary withdrawals).

CWS are not obliged to offer ‘catch-up’ classes and will not transfer any missed lesson(s) from your current term to an alternative term.  There may be circumstances out of our control, in which the pool might not be available for CWS lesson(s).  Examples of these circumstances include (but are not limited to) damage to the pool, severe weather conditions, power failures, industrial action, and Instructor sickness.

Where a lesson(s) are cancelled due to an unforeseen circumstance, or a lesson that is already in progress or about to start, must be cleared for any reason, CWS will automatically credit you with the correct amount for the following term.

Any catch-up lessons are at the discretion of CWS and depend on the circumstance of the absence.  CWS offers this service as a gesture of goodwill and is not statutorily obliged to do so.  This is limited to a maximum of 2 per term where possible for CWS to offer the catch-up class.

Refunds/Credits for Withdrawal on Medical Grounds:

After a course has started, if you wish to withdraw from the agreements of your booking on a medical basis we require an email/letter cancelling your course followed by a Doctor’s note from your GP, Consultant or Specialist within 7 days of your written cancellation, confirming the child should not swim (for at least 3 weeks).  Where agreed a credit for the balance of the sessions remaining from the date of the receipt of your written notification along with the doctor’s note.  If you wish to cancel a course on medical grounds before the term has started please follow our standard cancellation policy.

If you wish to cancel and you have a Direct Debit set up, it is YOUR RESPONSIBILITY to cancel this with your bank. No refunds will be given if you have stopped lessons but not cancelled the Direct Debit yourself.

  1.  Code of Conduct.

Please note, the Instructor will not allow in the water any child who does not wear the appropriate swimwear.

Spectators: 

We welcome parents/guardians for the first 2 lessons but for Health and Safety reasons and for the comfort of the students this is limited to 2 spectators per child in the designated viewing area.  Due to limited space only one parent/guardian per 2 children will be allowed inside the changing areas.  For the comfort of all students and staff, please ensure that any children under 8 are using the changing room of the gender of the adult not the child.  Children over 8 are permitted to use the changing rooms un-accompanied but remain the responsibility of the parent/guardian.

 

Lost property and Valuables: 

All property left in changing rooms, poolside or spectator’s areas, is left at your own risk.  CWS will not accept any responsibility for the loss or damage of any personal possessions.  Please note no personal items should be left on benches in the changing areas during the lessons.  Please either keep hold of your children’s items or use the lockers provided.  Odds and Ends lost property such as shampoo, dummies, socks etc. will be disposed of at the end of each day.

Photography and Video Recording:

We cannot allow photography or video recording on any device (including but not limited to mobile phones) during the lesson for health and safety reason.  All parents have signed a consent form regarding the use of professional photography and videos for CWS promotions and training purposes – for those parents who have not given consent for their child to be photographed, we will ensure they are not included.

Data Protection Policy:

CWS will not make use of or available any personal information that we hold to any third party, unless agreed upon when signing up. (i.e. Service information for discount)

CWS will not use your personal information except to send you promotions, mail marketing, course information and notifications.

Amendments to Terms & Conditions and Statutory Rights:

CWS reserves the right to amend its booking Terms and Conditions and associated documentation at any time.  These Terms and Conditions do not affect your statutory rights.
